Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • Website refers to Explorers’ Edge, accessible from https://explorersedge.ca/
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

The Company operates on the basis of a Privacy Policy and related procedures that guide the handling of the personal information We collect. We have created this privacy statement in order to demonstrate our firm commitment to protecting the privacy of our members, partners and potential website visitors. This policy and related procedures are consistent with the Canadian Standards Association Model Code for the Protection of Personal Information (herein ‘CSA Model Code’) and applicable privacy legislation.

This policy deals only with personal information handled by the Company. Personal information is information about an identifiable individual, excluding business contact information. The following explains how We handle personal information. The Company reserves the right to change this policy, and it may be updated periodically.  These changes may affect our use of Your personal information.   Accordingly, we will provide direct notification of changes to the Privacy Policy via email, telephone (if applicable), posting to the website via a banner on the home page, social media notification and press release.”  Additionally, we will provide Privacy Policy Check-Ins biannually via direct email to ensure users in order to:

  • Be transparent – We believe in being transparent about how we collect, use, and protect your data. By providing biannual privacy statement check-ins, we aim to keep you informed about any updates or changes to our privacy policies or practices.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain Your Data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company retains information only as long as is necessary to provide the individual with the requested product, service or information and delete or destroy this information after that time, i.e. if personal information is given to enable You to register for an event, the personal information will only be used for this event and will then be deleted or destroyed. In some cases, however, legal reporting and retention requirements necessitate that the Company retain information for a specific amount of time. In general, the Company retains information for a period not longer than one (1) year.

The Company does not sell or trade any personal information with third parties. the Company may transfer information to service providers where information processing is outsourced by the Company in the course of its administrative procedures or members services in specific cases. Where personal information is transferred to a service provider for processing, we require the service provider to respect this Privacy Policy, and we restrict them from using or disclosing personal information transferred to them for any purpose other than the provision of services to us. Any personal information that The Company retains is kept in such a manner as to ensure its security and confidentiality at all times.

The Company respects the privacy of our members, partners, potential website visitors and Internet users and will protect that privacy as vigorously as possible. The Company stores personal information in electronic and physical files that are secure. Our security measures include: secure locks on filing cabinets, and using industry-standard techniques such as firewalls, encryption, intrusion detection and restricted access to records and to equipment, including computers. Unfortunately, no data transmission over the Internet can be guaranteed to 100% secure. As a result, while the Company strives to protect Your personal information, we cannot ensure or warrant the security of any information You transmit to us or receive from us electronically. This is especially true for information You transmit to us via e-mail. We have no way of protecting that information until it reaches us. Once we receive Your transmission, we make our best efforts to ensure its security on our servers.

    • The process will further include follow-up correspondence with users regarding additional information or updates regarding the breach and its resolution.

  • In accordance with applicable laws and regulations, We will report the breach to the relevant regulatory authorities and comply with any required notification procedures.

  • Our team will take immediate action to address the cause of the breach and implement additional security measures to prevent similar incidents in the future.
  • We will work diligently to restore the integrity of our systems and ensure the ongoing security of user data.

  • We understand the concerns and inconvenience that a data breach can cause, and We are committed to providing support to affected individuals.
  • This may include offering credit monitoring services, identity theft protection, or other forms of assistance as appropriate.

The Company is dedicated to safeguarding the privacy and security of our users’ information, and We take any breaches of our security measures very seriously. We encourage users to contact us immediately if they have any concerns or believe their information may have been compromised.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your province/state, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

Delete Your Personal Data

You have the right to delete or request that we assist in deleting the Personal Data that we have collected about You.

You may contact us to request access to, correct, or delete any personal information that You have provided to us.

At the written request of an individual, You may view or edit their personal information as collected by the Company. The Company will inform You of what personal information we have about the individual, what it is being used for and, in cases where it has been disclosed, to whom it has been disclosed. There may be exceptional circumstances, as provided by the CSA Model Code, under which the Company may not be able to give an individual access to the personal information about You by the Company. In this case, We will explain the reason for this lack of access, as provided by the CSA Model Code.

To make a request, please send a letter, email or fax addressed to the RTO12 Privacy Officer at the address indicated at the end of this Privacy Policy. In Your request, please include the following information:

  • Name
  • Contact details
  • Membership Number (if applicable)

The nature of Your request, including whether You wish to view and/or edit information or inquire regarding use and/or disclosure.

The Company will reply to Your request no later than thirty (30) days after receipt of the request, or if we are not able to respond within this time period, we will send You a notice of extension. If we are not able to disclose all personal information we hold on You, we will give You a reason for our inability to do so unless prohibited by law.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement
